PTAB Hearing Concludes on August 29

2003 Onyx Orchard Hills property assessment reviewed

The Illinois Property Tax Appeal Board (PTAB) concluded an eight day hearing at the Ogle County Courthouse on August 29, 2007 regarding the Onyx (now Veolia) Orchard Hills Landfill located in Davis Junction, IL. The hearing reviewed the 2003 assessment determination made by the Ogle County Board of Review for the landfill.  The original assessed value for 2003 was set at $2.5 million.  Onyx Orchard Hills contested the assessment and sought a reduction to $1.6 million.  At the Ogle County Board of Review hearing, which was held in January of 2004, an appraisal of the landfill was presented. Based on that appraisal, the Ogle County Board of Review determined the assessed value of the Onyx Orchard Hills Landfill at $8.6 million.  The increased assessment resulted in an increase over $250,000 in property tax money to the Meridian School District. Onyx appealed the assessment determination to PTAB and the case was finally heard this past week in Oregon.

During the PTAB hearing, Onyx presented two appraisals for the property in addition to having several witnesses testify.  The School District presented the 2003 appraisal in addition to witnesses of its own.  A decision on the assessment is not expected until early next year.  If PTAB rules in favor of Onyx, the School District would need to pay back the difference in taxes received in 2003 in addition to the potential of repaying tax receipts for the 2004, 2005, and 2006 tax years which were all set at $8.6 million.
